1. Agreement to Terms

By placing an order, making a payment, or accepting delivery, you agree to be legally bound by these Terms & Conditions in accordance with the laws of Ontario, Canada.


2. Payment Terms 

2.1 Custom Orders

  • A 50% non-refundable deposit is required to begin production.
  • 25% payment is due upon completion.
  • The remaining 25% must be paid before delivery or pickup.

2.2 Full Payment Requirement

Full (100%) payment must be completed prior to:

  • Delivery
  • Pickup
  • Unloading

Note: Products will not be delivered, released, or unloaded until full payment is received.


3. Pricing Policy

  • All prices are fixed at the time of order.
  • Additional charges may apply for:
    • Delivery
    • Handling and movement
    • Stair access or upper-floor delivery
    • Special placement within the property

4. Delivery Policy

4.1 General Conditions

  • Delivery charges are separate from product pricing.
  • Delivery may be completed by S&Y Woodworks or third-party providers.

Disclaimer: S&Y Woodworks is not responsible for delays or damage caused by third-party delivery services.


4.2 Payment Before Delivery

  • Full payment is required before delivery.
  • No unloading or handover will occur without complete payment.

4.3 Right to Refuse Delivery

S&Y Woodworks reserves the right to refuse or limit delivery if there is a risk of:

  • Property damage
  • Product damage
  • Unsafe access

Delivery may be limited to doorstep only.


4.4 Risk During Handling Inside Property

S&Y Woodworks is not liable for any damage during:

  • Moving products inside the property
  • Stair handling
  • Tight or restricted access areas

This includes damage to:

  • Walls, floors, furniture, or the product

By proceeding, the customer accepts all such risks.


4.5 Additional Delivery Charges

Extra charges may apply for:

  • Upper floors
  • Placement inside rooms
  • Complex handling requirements

4.6 Pickup & Storage Policy

  • If delivery cannot be completed, the customer must arrange pickup.
  • After 30 days, a storage fee of $10 per day will apply.
  • After notice, uncollected items may be resold or disposed of.

5. Custom Orders (Strict Policy)

5.1 Nature of Custom Work

All custom products are:

  • Made according to customer specifications
  • Non-resellable

5.2 No Refund Policy

All custom orders are final sale and non-refundable, except where required by law.

This includes:

  • Change of mind
  • Design dissatisfaction
  • Personal preference concerns

5.3 Design Approval & Customer Responsibility

The customer acknowledges that all designs, dimensions, carvings, and cuts are completed strictly based on:

  • Customer approval
  • Customer-selected design

Color, Finish & Stain Responsibility

If the customer selects their own:

  • Color
  • Stain
  • Finish

Even after S&Y Woodworks has:

  • Provided recommendations
  • Suggested better options
  • Shared samples or references

S&Y Woodworks is not responsible for:

  • Final appearance
  • Perceived finish quality
  • Customer dissatisfaction

No Liability for Design Preferences

Once approved, the customer cannot claim dissatisfaction based on:

  • Appearance
  • Color
  • Finish
  • Design style

5.4 Approval Before Delivery

The customer must approve the product through:

  • In-store inspection
    OR
  • Photos/videos

5.5 Refusal at Delivery

If the customer refuses delivery:

  • No refund will be issued
  • The customer must pay:
    • Return delivery charges
    • 15% restoration fee

5.6 Legal Protection (Ontario Compliance)

Nothing in these Terms removes customer rights where:

  • The product is defective
  • The product does not match approved specifications
  • There is proven negligence

Clarifications:

  • Defective products will be repaired or replaced at S&Y’s discretion
  • Design dissatisfaction is not valid if the product matches approval
  • Delays caused by suppliers, materials, or third parties do not qualify for refunds or cancellations

6. Returns (Non-Custom Orders Only)

  • Returns are accepted at the sole discretion of S&Y Woodworks
  • A minimum 50% deduction applies
  • Delivery charges are non-refundable
  • Return shipping is paid by the customer

7. Liability & Damage

S&Y Woodworks is not responsible for:

  • Damage due to access limitations
  • Damage during handling inside the property

Exception: Where required by law, including cases of gross negligence.


8. Indemnity

The customer agrees to indemnify S&Y Woodworks against:

  • Claims related to delivery conditions
  • Property-related risks
  • Customer instructions

9. Chargeback Policy

The customer agrees:

  • To contact S&Y Woodworks before initiating any dispute
  • Unauthorized chargebacks will be considered a breach of agreement

10. Limitation of Liability

Liability is limited to the total amount paid, as permitted under Ontario law.


11. Customer Responsibilities

The customer must:

  • Provide accurate information
  • Ensure safe access for delivery
  • Approve designs before production
  • Make payments on time
